On October 3, 2023, the Ministry of Industry and Trade issued Decision No. 2537/QD-BCT on the sunset review of the application of anti-dumping measures (AD) against certain aluminum products from the People's Republic of China, classified under HS code 7604.10.10, 7604.10.90, 7604.21.90, 7604.29.10, and 7604.29.90 (Case No.: ER01.AD05).
This Decision regarding the sunset review was issued based on the provisions of the law on trade remedies in order to determine the necessity, rationality, and socio-economic impact of continuing to apply anti-dumping measures on imported aluminum products, assess the possibility of continuing or recurring dumping causing damage to the domestic manufacturing industry in case of termination of anti-dumping measures.

According to regulations, after initiating an investigation, the Investigating Authority will send a questionnaire to the relevant parties to gather information for analyzing and evaluating the following contents: (i) the possibility of imported goods being sold at dumped prices if anti-dumping measures are terminated; (ii) the possibility of significant damage or significant threatened damage to the domestic industry if the application of anti-dumping measures is terminated; and (iii) the causal relationship between the possibility of dumping and the damage that the domestic industry must bear.
The Ministry of Industry and Trade will conduct a review and verification of the information provided by the relevant parties before completing the official investigation conclusion on the incident. At the same time, the Ministry of Industry and Trade will also organize public consultations for the directly involved parties to exchange information, express their views on the incident before reaching a final conclusion on the matter.
The Ministry of Industry and Trade recommends that all organizations and individuals involved in importing, distributing, trading, and using the product under investigation register as relevant parties and provide necessary information to ensure their rights and interests in accordance with the law.
Organizations and individuals can register as relevant parties with the Investigating Authority through the Registration Form for Relevant Parties issued in Appendix 1 attached to Circular No. 37/2019/TT-BCT dated November 29, 2019 by the Minister of Industry and Trade, which details certain contents regarding trade defense measures and send it to the Investigating Authority at the address below by the following methods: (i) official letter or (ii) email.
The deadline for registering as a relevant party is December 18, 2023.
